By creating an account, accessing the platform, or using LuData services via the web interface, API, or associated tools, users acknowledge that they have read, understood, and agree to be bound by these Legal Terms and Policies.

LuData is a digital platform providing access to environmental datasets, analytical models, and technical protocols through both a web interface and an API infrastructure.

LuData may host services, datasets, analytical models, and protocols provided by Lucisun as well as by third-party providers. Lucisun may act as a technical intermediary, exposing such services through the LuData API and interface.
Third-party providers remain responsible for the content and operation of their services and retain ownership of their intellectual property. Lucisun does not guarantee the accuracy, reliability, or completeness of third-party services.
Access to certain LuData services requires the creation of a user account. Users agree to provide accurate information and maintain the confidentiality of login credentials, API keys, and authentication tokens. Users are responsible for all activities conducted through their account.
LuData services may be accessed through the web interface, the API, or the API manager.

LuData services are offered through subscription plans. Subscriptions allocate usage capacity such as Site Units, credits, or service quotas. Usage may be calculated based on data volume, requested variables, or processing services used.
Subscriptions may be billed annually with periodic invoicing cycles. Subscriptions renew automatically unless cancellation is requested via support@lucisun.be.
Credits included in subscription plans are generally valid for one year from the beginning of the subscription period. Lucisun may allow extended use of remaining credits when users commit to renewing their subscription.
Refund requests may be submitted to support@lucisun.be for billing errors, technical issues preventing service use, or exceptional circumstances. Payments are processed by third-party processors including Stripe.
All intellectual property rights remain the property of Lucisun or its licensors. Users receive a limited, non-exclusive license for internal analysis, engineering studies, reporting, or research.
Users may not:
LuData aggregates datasets from multiple sources including satellite observations and meteorological models. Lucisun may aggregate, harmonize, process, enhance, or combine such datasets with proprietary models. Specific sources or methodologies may not be publicly disclosed for commercial reasons.
All datasets are delivered “as-is”. Environmental datasets may contain uncertainties. LuData services do not constitute engineering, financial, or investment advice. Users must independently verify outputs before use in design or investment decisions.
Lucisun aims for high availability but the platform is provided on a best-effort basis. Enterprise customers may benefit from contractual Service Level Agreements (SLA) through separate agreements.
Users remain responsible for ensuring they have rights to upload datasets. By uploading, users grant Lucisun a limited license to process the data for service delivery. Lucisun does not claim ownership of user uploaded data.
Lucisun reserves the right to suspend accounts for terms violation, abusive API usage, fraudulent activity, or non-payment. Suspensions may occur without prior notice when necessary to protect the platform.
Lucisun shall not be liable for indirect damages, loss of profits, or business interruption. Total cumulative liability shall not exceed the amount paid by the user for services during the twelve (12) months preceding the claim.
Users agree to indemnify Lucisun from any claims or legal costs resulting from misuse of the platform, violation of these terms, or infringement of third-party rights.
Lucisun processes personal data (email, company info, usage logs) in accordance with GDPR and Belgian data protection laws. Users may request data access or deletion via support@lucisun.be.
LuData uses necessary cookies and analytics tools (e.g., Google Analytics) to analyze platform usage. Users may manage these through browser settings.
Infrastructure may be hosted on cloud providers including DigitalOcean and Hetzner. Data is stored within the European Union using reasonable technical and organizational protection measures.
Users must comply with all applicable export control and sanctions laws. Services must not be used in violation of international regulations.
Lucisun shall not be liable for delays caused by natural disasters, war, internet infrastructure failures, or cloud provider outages beyond its reasonable control.
Lucisun reserves the right to modify these terms. Continued use of LuData after changes constitutes acceptance of updated terms. Significant changes may be communicated via the platform or email.
These Legal Terms and Policies are governed by Belgian law. Any disputes shall fall under the jurisdiction of the Belgian courts.
